The Council of Europe is currently drafting a legal instrument on protecting whistleblowers. In their recommendations the Council states that employers should be encouraged to put in place internal reporting procedures and that where an employer has put in place an internal reporting system, and the whistleblower has made a disclosure to the public without resorting to the system, this may be taken into consideration when deciding on the remedies or level of protection to afford to the whistleblower.

The recommendation will be submitted to the Committee of Ministers with a view to its possible adoption end April 2014. Read the draft recommendation.
